Unpaid Time / Overtime
The Fair Labor Standards Act (FLSA) protects employees' rights to fair pay, ensuring that covered employees receive a federal minimum wage of at least $7.25 per hour, as well as mandating that the vast majority of America's work force receive overtime compensation at a rate of not less than time and a half, for all hours worked over 40 in a workweek. These overtime labor laws are in place to ensure that an employer adequately compensates his or her employee for their toils. However, many employers look for ways to avoid paying employees for overtime.
The vast majority of American workers are eligible to receive overtime. Certain exemptions apply to executives, professionals, and other types of workers. These exemptions are narrowly defined so that only a limited group of people are categorized as exempt from the right to receive overtime. If you are a non-exempt employee and you work more than 40 hours per week, you are entitled to overtime pay.
Regardless of whether you choose to bring a lawsuit for back wages, you should be separately tracking your hours so that you know whether you have been paid correctly. In preparation for the pursuit of a claim, all documents associated with your job duties, hours worked, and rate of pay should be gathered, as well as any other information that would be helpful, such as leave policies, timesheets, pay stubs, employee handbooks, and other information.
