Rewards for SEC Whistleblowers

The Dodd-Frank Wall Street Reform and Consumer Protection Act gives the SEC authority to reward whistleblowers who report fraud to the SEC . A whistleblower can receive a reward for disclosing “original information” of an unlawful activity, leading to a recovery of more than $1 million for the SEC. Typically these rewards range from 10 to 30% of the amount the SEC receives.

What is "Original Information"?

"Original Information" is information that is

  1. knowledge the whistleblower came by independently,
  2. not previously provided to the SEC from another source,
  3. not exclusively derived from an allegation made in a judicial or administrative hearing or other public disclosure.

SEC Whistleblower Protection

The Dodd-Frank bill prohibits employers from terminating or discriminating against SEC whistleblowers. It also prevents judicial or administrative actions relating to whistleblower statements.
